The Department of Labor has been given another extension to file its overtime rule brief to the 5th U.S. Circuit Court of Appeals, this time through June 30. Last fall, the DOL was barred by 21 states from implementing a raise in the rate for overtime exemption from $23,660 to $47,476. The DOL has appealed but has asked for extensions on filing its brief to the appeals court, in part due to the lack of a Labor Secretary from the new administration. Alexander Acosta is slated for the job but has yet to be confirmed by the Senate. Acosta has indicated he’d like to see an exemption increase, though not as high as the current case proposes.
